Dialectical Theory

Interpersonal relationships have been the subject of research and discussion for many centuries. Whether a relationship lasts or breaks depends so much on how the parties involved respond to the emerging challenges and how they respond to issues. According to the dialectic theory, all relationships undergo tensions which often result into contradictions. It is how the parties engaged in a relationship respond to tensions that shapes the way parties will handle tensions. For a husband and wife in a marriage or a boyfriend and girl friend in a love affair, the knowledge of the underlying assumptions of the dialectic theory is fundamental. This essay looks into the impact of dialectical tensions in relationships, the management of tensions in relationships and finally the strategies those in relationships can adopt to deal with tensions. The writer incorporates personal experience of tensions to expound and make clearer the points deliberated. Autonomy This is the desire to be independent in the things that you set out to do and also in your entire life. It occurs regardless of the closeness or intimacy that one has established with his/her partner or even with other people. The need to be autonomous in a relationship may lead to conflicts since your partner expects you to cooperate and do everything together inclusive of sharing ideas and experiences. Individual identity This refers to the process of trying to understand oneself in a better way. It involves making attempts of stabling ones weaknesses and strengths so that one can be able to his/her living grounds. It can result to tensions in a relationship in that on the process of trying to understand yourself your weaknesses may outweigh your strengths and this may bring about doubts on the side of tour partner. Change This is the desire to acquire and sustain variety for example in a relationship. It can be both positive and negative whereby negative change brings about much tension in a relationship. This refers to turning against the plans and agreements that were entered into during the beginning of the relationship. Desire for Separation This refers to the strong need to part ways with your partner may be because of inevitable circumstances like a job or due to existence of varied decisions between the partners whereby none wants to give in to each other’s decisions. This leads to tensions in a relationship and it can even yield into a divorce. Varied approaches- this refers to use of different means and ways to solve problems or address issues in the relationship by the partners. The partners may therefore have a lot of disagreements and this strains and puts tensions to the relationship. Privacy- this refers to the tendency of keeping things to oneself. The partners may decide not to disclose anything to each other and this really puts a lot of tension to the relationship since open-ness is not practiced. I have been in an intimate relationship for the past five years. Although there have been fundamental communication differences, at least the theory of dialectical tensions has been evident through out. There have been tensions which require to be solved constantly. First of all, my partner is from a different religious background, very committed and totally unyielding to compromise. Constantly the practices and doctrines he advocates are against my personal beliefs. On the other hand, I am reserved and although religious, I am not overly given into religiosity as was the case with my partner. Dialectical tensions are manifested in that, while my partner desires to have a baby I do not and often it is a subject of debate, something which has been going on and on for the last three years. Although both of us have learnt how to balance the tensions, it has taken quite a number of strategies and a good measure of effort. First of all, we had to agree on how many kids we were going to have if any. Secondly, we were in different careers with different goals in life. The prospects of marriage and therefore of having to raise a family together implied that one or both of us had to make quick changes to career path and it turned out to be me. This obviously was the last thing I had anticipated for and my family members as well as close friends were very much against such a decision. So a decision had to be made and for that matter very fast. To achieve a balance of the contradictions I had to balance between what I wanted for my relationship versus what my friends and family wanted for me. I also had to balance between the career and the prospects of changing as well as the cost that goes with raising a well rounded family. I also had to balance between being faithful and obedient to my spouse and being truthful to myself. Integration/separation. The fact that I was changing career paths in order to be together with my spouse meant that, I was undergoing a major dilemma as far as sacrificing my identity was concerned. We were going to integrate into marriage and therefore someone if not both of us needed to make some sacrifices. I made some. In terms of the advice and discouragement from my friends, I had to ignore their pleas. This was a separation in that, my decision which was final was against their advice and therefore a separation resulted. Stability/change. Having underwent several relationships which were all intimate, switching or at least breaking one and later forming another was a change in itself. This resulted into stability tension in that. Every time I entered into a relationship, I never wanted to break it even if it seemed like it was not headed into a marriage. There was and imminent fear of life without this and that partner and this was a major cause of stability tension for me. Expression/privacy. This tension has continued to grip me to date, disclosing to my partner something has never been easy especially when the consequences are not clear and are unpredictable. In my current relationship, I am the private one while my partner is the open one. While my partner can virtually open up about any issue however damaging or secret, I always find myself struggling to do that. It takes a lot of pestering to get information out of me especially when I consider the information potentially damaging. Strategies of responding to the above tensions. The strategies discussed here are real and have worked for me. In my relationship whereby the partner and I have major differences, including religious beliefs, I had to select to hang by my feelings and choice of action. It was not going to join my partners bandwagon and subscribe to the religious sect he belonged to. This eventually worked as he later accepted my choice. If I had acted in order to please him, I was going to suffer. I would have just sacrificed too much for nothing. In that, my strategy worked. By sticking to my position but still maintaining the relationship, I learnt how to cope with the tension of differences. In all other relationships before marriage, I ended up adopting separation strategy hence the reason why I would break up if a relationship was not working. Reaffirmation to me was not an ideal strategy in my relationship, although I hold the view that, it is applicable in cases whereby a spouse may be sickly but however serious the condition, the loved ones look up to the person getting well one day. In some cases it could be that, a relationship is abusive and a partner keeps on promising that they will change although actually nothing ever happens. Reframing again for me is a strategy I use in my current situation whereby I look at the demands of my relationship differently and therefore gives a new meaning to every contradiction. The tension of having to change career path so as to marry was a dialectical tension I overcame using the reframing strategy. Conclusion. Dialectical theory is very much effective for relationships and I would suggest it to all of the buddies out there who are undergoing hard times in their relationships. From the meanings to the strategies, an in-depth solution to tensions is offered. Therefore theoretical theory is an ideal alternative to solving crisis in relationships.

This is a dilemma that occurs to be of special truth to the developing countries who are not given the luxury of financial and technological resources to address the issues associated with the environment. Definitely, there are a lot of issues and related costs that are borne with every legal statute passed for the purpose of protecting the environment. From the implantation of it come the associated resources in terms of manpower and other needs. Over time, it has been the case that the cost of the environmental degradation that occurred, and is still occurring, becomes harder to quantify in financial terms. The costs are usually measured and derived from air and water quality as examples (Ahmed & Sanchez-Triana, 2008). However, it should be noted that it is not the financial quantification of this particular endeavor that matters but the present impact and the long-term goals that should be foreseen. First, it is seen that the adverse effects brought about by the inability of the environment to keep with the needs of the human population is already being felt by people. There are different groups that can be identified in terms of the socio-economic classes to which they belong and the degree to which they are disadvantaged because of certain characteristics. The benefits that could be derived from the simple laws that protect their basic needs such as the access to clean water vary from one group to another. Another consideration for this is that the impacts have led to a domino-effect where it has indirectly affected the entire society and should the provision of safety nets through legal policies are definitely an urgent need to solve several interlocking problems that have come in lieu of the environmental degradation. Second, the long-term effects brought about by the legal statutes would definitely help not only the generations in immediate succession of the present but would also last until a few more decades, if not centuries (Gillespie, 1997). Leadership has the responsibility to ensure the opportunity for meaning and aspiration occur within the organization, great leaders strive to continually inspire such. Management has the opportunity to see to it that meaning and aspiration is actually being achieved while leadership creates the atmosphere for it to thrive. 1.Management challenges the vision of the company, which was created by leadership as to ensure the desired results are being achieved, while leadership identifies continual opportunities for a greater vision. According to Nonaka (quoted from Dance of Change), â€Å"A company is not a machine but a living organism. Much like an individual, it can have a collective sense of identity and shared purpose†¦ a shared understanding of what the company stands for†. Leadership must create opportunities for that shared vision and collective sense of identity to emerge. Leadership can inspire this to happen through management developing initiatives within cross-department relationship building and teamwork building. Management has the responsibility to ensure this takes place while leadership sets the strategy and places the goals high on the corporate agenda. Leadership sets the priorities, while management gets the priorities done. Among many other tasks, Leadership has the responsibility to: 1.Develop an overall strategic vision for the organization or team 2.In conjunction with the organization, drive the desired results 3.Enable an atmosphere which encourages cross-functional teamwork 4.Be in-touch with the organization at all levels 5.Asks the high-level questions and ensures the answers are understood by all in the organization 6.Encourages the organization to explore alternatives and better ways of doing business 7.Assists the organization to see the big picture In contrast among other tasks, management has the following responsibilities: 1.Management includes the actual coordination of processes and work-flows 2.Includes the process of evaluating resources, assessment and measurement of various pieces throughout the organizations 3.Management includes ensuring that all feedback, comments, and innovative change initiative ideas are brought to the forefront of the decision making process 4.Seeks to make the planning process a more successful endeavor 5.Helps to implement the answers to the big questions into best practices for the organization The Role of Leadership in Strategy The role of leadership in strategy includes many facets some that are tangible and some that are not. For example the role of leadership in strategy is to determine what the big picture is and to ensure the organization has a plan for discovering those answers to the big questions. I believe the role of leadership in developing strategy is to create many areas of possibility for the organization and to create an atmosphere where employees feel committed to creating those possibilities. The example provided by Senge about what was happening in South Africa in the early 1990s is a great one. Leadership of South Africa was trying to develop a set of alternative stories about what might happen in South Africa. They came together and developed several stories and tried to examine what the country will look like in the future. Leadership in fact, was trying to shape and define the story and to have this story be as positive as possible for the country. I believe the same high-level story development is the main responsibility of leadership in strategy for an organization at all levels. The role is for the leadership to define how they want the company to interact in the world and to develop a story that is much bigger than the organization. This story must be believed by all participants in the organization and must be walked the talk by leadership. For example the role of leadership in defining one of the key tenants for Whole Foods is â€Å"We Sell the Highest Quality Natural and Organic Products Available†. The role of leadership in developing this strategy is key to the companies fundamental belief system, and many of the employees and customers are committed to this strategy. The role of leadership is to create the vision and ensure it is in real congruence with the organizational realty. How is leadership critical to realizing strategy? I believe without leadership, strategy cannot be truly realized for a sustainable period. For example if there lacks a person or people who rise above and create the vision and see to it, that it is a manifestation throughout the organization, the strategy will be lost at sea. The waves of business cycles and changing resources will ensure the strategy is tossed and turned and will not go on a path toward true-fulfillment of the highest levels of success. Leadership sets the stage for strategy by asking the core questions, shaping the vision, and allowing for an atmosphere, which encourages the awareness and commitment to the strategy. Leadership is critical: 1.It creates a vessel for continuous improvement and adaptation of strategy 1.Ensures the proper questions are asked and answered 2.Creates an atmosphere for growth and change 3.Demonstrates effective behavior 4.Tries to get the highest potential out of resources 5.Creates the strategic vision 6.Brings together key aspects of the strategy The world we live in is changing at an alarming rate as a result of all the new discoveries that have been made over the years. These new discoveries have been aided by the availability of better learning facilities and equipment. These were not available in the early days. As scientists continue to discover and invent new equipment, the world is adapting them and incorporating them in the societies. As a result, the world we are living in is heavily dependent on inventions and machines to carry out tasks. Moreover, as a result of the advanced technology, people are getting more intelligent hence they are able carry out more researches of their own as well as make their own new inventions. Skrzynecki and Lord of the Flies Essay ‘A feeling of belonging depends on a strong relationship, developed over a period of time. ’ To what extent would you support this viewpoint? In your essay refer in detail to your prescribed text and at least ONE other related text of your own choosing. According to sociobiologists, the need for human connection and belonging is hardwired and genetically dictated. It defines ‘who’ and ‘what’ we are, and how we fit into the world around us. An individual’s sense of connection may be influenced by many factors, but one of the strongest of these is a strong relationship or relationships, which have been developed over a period of time. This human connection is instrumental in defining an individual’s place in the world as well as his or her sense of belonging. The notion that a feeling of belonging depends on a strong relationship is explored in Peter Skrzynecki’s prose poetry anthology Immigrant Chronicle (1975) – in particular the poems ‘Migrant Hostel’ in which the persona and his family struggle to gain lasting relationships at the hostel, and ’10 Mary Street’, the persona’s childhood home, in which strong familial relationships were forged – and William Golding’s prose fiction text Lord of the Flies (1958), in which a group of school boys stranded on an island gradually lose any strong relationships they may have had as their civilisation descends into violence and savagery. Both these texts memorably and distinctively explore how relationships and acceptance can shape an individual’s perceptions of belonging and not belonging. Set in the context of a post-war assimilationist culture, Migrant Hostel represents the immense sense of disconnection experienced by the persona and his family, given both their dislocation from their European homeland and their lack of strong relationships with the other members of the hostel. The migrants transitory existence is emphasised through the use of a migratory bird simile For over two years we lived like birds of passage, always sensing a chance in the weather while through the use of connotative language to highlight the personas disconnection, the poem provides an overall sense of helplessness and lack of autonomy in determining their own future Sudden departures from adjoining blocks that left us wondering who would be coming next thus constructing the hostel as a place of impotence and impermanence. This evident transience is perhaps symbolic of the migrants own fleeting sense of connection as they instinctively seek out members of their own culture, efficaciously conveyed through the use of a familiar analogy – â€Å"nationalities sought/each other out instinctively – like a homing pigeon/circling to get its bearings†. These superficial relationships thus serve to hinder the development of any lasting sense of belonging – regardless of a common history and identity – as, whilst for some migrants, their time in the hostel represents a new beginning, for others the sustained sense of alienation and despair, due to a lack of strong relationships, becomes too difficult to bear, as the final lines of the poem poignantly suggest through juxtaposition – â€Å"lives/that had only begun/or were dying†. Thus a feeling of belonging depends on a strong relationship, developed over a period of time. Standing in stark contrast to ‘Migrant Hostel’ is the poem ’10 Mary Street’, which portrays the persona’s strong feelings of belonging to his childhood home as a result of the strong familial relationships which were forged during his time there. The family’s domestic routine is depicted and their unity of existence is simply, but effectively conveyed in the first stanza through inclusive language â€Å"We departed/Each morning, shut the house/Like a well-oiled lock†, alluding to their sense of family security. The beginning of the second stanza alludes to the fact that, despite the family’s integration into mainstream society, their socioeconomic marginalisation continues. Through the simple use of connotation and onomatopoeia, the responder is positioned to recognise the mundane nature of the menial labour the persona’s parents nevertheless stoically endure – â€Å"From the polite hum-drum/Of washing clothes/And laying sewage pipes†. Consequently, it is in the context of the Skrzynecki family’s ongoing marginalisation that the sense of belonging afforded by the family home gains deeper significance. Feelings of nourishment and well-being are generated through combining a simile and cumulative imagery as the persona’s parents extend their nurturing to the family garden – â€Å"My parents watered/Plants- grew potatoes/ And rows of sweet corn:/ Tended the roses and camellias/ Like adopted children†. Thus, the persona’s strong sense of belonging as depicted in this poem is a result of the strong relationships with his family which were forged during his time there. While similar to Immigrant Chronicle on a superficial level, to the extent that both texts represent individual’s experiences of alienation and dislocation, Golding’s text Lord of the Flies explores representations of belonging, in terms of relationships, differently. Composed in the context of the Cold War nuclear arms power race, Golding’s text can be read as an allegory of the impossibility of human civilisation in which individuals are able to coexist without ultimately resorting to violence and savagery. The character of Piggy represents the scientific and rational side of society – portrayed in this text as a minority. From the beginning of the novel, Piggy has little by way of close relationships – â€Å"A storm of laughter arose and even the tiniest child joined in. For the moment the boys were a closed circuit of sympathy with Piggy on the outside. † It is in this moment that both the extent of Piggy’s alienation is highlighted while the disintegration into chaos and disorder is also foreshadowed through the breaking of Piggys glasses, a symbol of rational civilisation. When Piggy’s glasses are broken during a major battle between Ralph and Jack towards the end of the book, this destruction symbolises the ultimate desolation of civilisation on the island, and, with it, any sense of belonging that the boys on the island had attempted to inculcate. This destruction can be viewed as a decimation of any strong relationships that the boys may have had – particularly between Piggy, Ralph and Jack – and can be read as reason for the poignant lack of belonging on the island. Jack Merridew, who begins as the head hunter, comes to embody the spirit of chaos and destruction on the island. While it can be argued that it is Jack’s lack of a strong ‘familial’ relationship with Ralph and Piggy that incites his search for power, Golding implies that the human instinct of barbarism greatly outweighs that of civilisation. When Jack first realises how much power he has, any sense of belonging he feels to the other boys is annihilated, the moment when Jack and his hunters finally manage to capture and kill a pig, marking Jack’s descent into bestial savagery, – â€Å"Look! We’ve killed a pig – we stole up on them – we got in a circle –†. The hyphenation utilised in this dialogue is subtly indicative of Jack’s inevitable loss of any sense of civility as he develops a warped relationship to his barbaric activities, ultimately seducing the majority of the boys off to a separate camp, where their descent into primitive barbarism becomes evident – â€Å"The chief was sitting there, naked to the waist, his face blocked out in white and red. The tribe lay in a semicircle before him. While giving Jack a sense of power and self-importance, this new ‘tribe’, built on a mutual savage desire for food, has diminished the boys’ sense of friendship and camaraderie. It is this lack of a strong relationship developed over a period of time which is cause for their lack of a strong sense of belonging. Evidently it is clear, upon examination of Immigrant Chronicle and Lord of the Flies, that a feeling o f belonging relies heavily on a strong relationship developed over a period of time. In Skrzynecki’s poem ‘Migrant Hostel’, the persona’s evocative sense of isolation is due to his lack of any strong relationships as well as any attempts at establishing them. In contrast to this, ’10 Mary Street’ clearly provides a strong sense of belonging as a result of the persona’s strong familial relationships. In Lord of the Flies, the boys stranded on the island attempt to cling to their superficial relationships to each other, but, in the face of dwindling food supplies, eventually descend into savagery, diminishing their relationships and ultimately their sense of belonging.

According to the survey, America is one of the biggest business partners of China; it continues to maintain Chinas second largest trading partner, bilateral trade amounted to 102.34 billion U.S. dollars, an increase of 11.4%. Among them, Chinas exports to the U.S. $ 74,300,000,000, an increase of 6.9%,more than a quarter of accelerating 1.5 percentage points over the same period accounted for 17.5% of the total value of Chinese exports; imported 28.04 billion U.S. dollars from the United States, an increase of 25.6%, trade surplus of 46.26 billion U.S. Dollars. As trade increases, more and more American companies have chosen to develop the Chinese market. While the problem also appears, it is difficult to negotiate with the Chinese. With the 5,000 years Chinese traditional culture, many multinational firms realized that China has her own negotiation style. This issue was mentioned by Lucian Pye (1992, p.74, cited by Tian, 2007), the Chinese may be less developed in technology and industrial organization than we, but for centuries they have known few peers in the subtle art of negotiating . When measured against the effort and skill the Chinese bring to the bargaining table, American executives fall short. From the above background, we can see that if the foreign business people want to do business in China, learning Chinese negotiation style is very important. With inadequate knowledge and skills of Chinese negotiation style, it will be difficult for Americans to succeed in striking a desirable deal with Chinese partners and in developing business in China. For this aim, this essay will do a systematically analysis on how to negotiation with Chinese, particularly for the Americans. This essay aims for set out how to understand Chinese negotiation style and find out the differences of negotiation styles between Chinese and Americans, to provide useful information on how to achieve a win-win object. In this essay, the main body will be the analysis of Chinese negotiation style. Section one will introduce some fundamental information of negotiation; in section two, the Chinese culture roots will be illustrated; in section three, the comparison of negotiation style between Chinese and Americans will be indicated; in section four, the conclusion will be given which is even though there are many differences among negotiation styles, the common rules still existed among these countries. Negotiation Based on Tian (2007), there are two parts contribute to negotiation process, which are common interests and conflicting interests. However, many scholars hold divergent views from different perspectives. From the social exchange theory, it defines negotiation as a process, which focus on problem-solving communication for both parties aims for a win-win agreement (McCall and Warrington, 1984; Graham, 1986, cited by Tian, 2007). Which means it focuses on how to maximize the benefits accruing to all parties. Therefore, it can be seen there is a positive relationship between two parties without hurting each other, the conflicts will also be addressed in a way that benefits all. Specifically, social exchange theory insists on a cooperative strategy of negotiation. This implies that both parties need to collaborate with each other and unify the interests of all aim for achieve mutual benefits. The cooperative strategy is illustrated as principled negotiation. As a principled negotiation, it focuses on: separate the human from the problem; focus on benefits rather than positions; options for mutual benefits; insist on objective criteria and no tricks and posturing. In all, the negotiation parties can gain from negotiation in a decent and fair manner. (Tian, 2007). Another theory is the game theory. This theory emphasizes on a win or lose agreement. It considers negotiation as a process that both parties communicate with each other in a competitive manner. (Raiffa, 1982; Siebe, 1991, cited by Tian, 2007). It defines negotiation as each party wants to maximize its own benefits at the cost of the other side. During negotiation all the parties can fight with one another in order to maximize their own interests. Hence, we can see that game theory is based on a competitive strategy. The third theory is called cross-cultural theory. This theory focuses on a specific type of negotiation, which is the different culture background. It indicates that different cultures may lead to different negotiation styles. Based on Tian (2007), game theory and social exchange theory have few implications on negotiation process, while the most influential factor is negotiators from different culture backgrounds need to have a basic understanding of each others cultural environments and negotiation styles; this will very helpful on the success of negotiation. In this essay, we will focus on the cross-cultural negotiation style to analysis the Chinese and Americans negotiation. Cultural roots of the Chinese negotiation style Lots of scholars argued that Chinese culture can be divided into two aspects; one is traditional Chinese culture, the other one is contemporary Chinese political culture (Tian, 2007; Fang and Ghauri). Traditional Chinese culture Confucianism is one of the most influential factors on Chinese negotiation style. There are six basic Confucian values. Firstly it emphasizes on moral cultivation. It regards trust and sincerity as the most important qualities. Secondly, it thinks highly of interpersonal relationships. Guanxi is a major mechanism in the Chinese social psychology. Thirdly, Confucianism pays attention on family and group orientation. The fourth factor is the respect of the age and hierarchy. Being a Chinese who needs to show respect to the aged people; for hierarchy, people should does his duty to contribute to social harmony and stability. The fifth factor is harmony first. Confucianism highlighted the need aim for harmony in the whole society by moral conduct in all kinds of relationships. The last factor is face, Confucianism educated the people they all should have a sense of shame in their minds. Face is a fundamental moral mechanism on Chinese way of life. (Fang and Ghauri). Sun Tzus stratagems: which known as Ji or Chinese stratagems, has a huge impact on Chinese strategic business behaviour. Sun Tzus provides Chinese with various kinds of solutions when facing different situations; how to gain psychological and material advantage to achieve ones purpose. Chinese negotiator is often Sun-Tzu-like strategist, seldom wages a physical business war but rather might be keen on a psychological wrestling of wit to create a favourable situation to manipulate his/her counterpart into doing business his/her way. (Fang and Ghauri; Chas.W, 1999). The most popular part of Sun Tzus stratagems is the Thirty-six ancient Chinese stratagems. Agrarian mentalities: China has a large agrarian population fir over 4,000 years. Even during the Cultural Revolution during 1966-1976, millions of students in urban areas were sent to the countryside by Mao Zedong to let them re-educated by the peasants. Even though most of the students went back to the city they still passed their re-educated values gained from countryside to their off springs; which is completely different with western countries. Based on many scholars research, (Tian, 2007; Graham and Lam; Pye, 1992), thrift and endurance are the most outstanding characteristics of the agrarian mindset when Chinese negotiating. So the agrarian mentalities continue to have a big influence on the way of thinking of the Chinese. Political Culture Mao Zedongs bureaucratic heritage and Deng Xiaopings pragmatism are the most important political cultures in China. Mao Zedongs bureaucratic heritage: this political culture based on orthodox Marxist-Leninist ideology with three main features. Firstly, the leader of the party has the biggest power on political and personnel. Secondly, fragmented and stratified bureaucratic agencies. Different ministries, province governments, government departments and agencies bargain and compete with each other over allocation of limited resources. Bureaucrats typically have good skills of bargaining within the system. Thirdly, the art of survival in the bureaucracy was responsibility avoided. The reason for this is how the unique bureaucratic system works. In China, power means everything especially in political, therefore, everyone tried very hard to avoid mistakes so they can stay at the office as usual. Some of them do everything based on orthodox Marxist-Leninist doctrines, some shifting responsibilities onto the others. Deng Xiaopings pragmatism: Deng is the leader of China economy reform which begun with market-oriented economy reform. During the reform period, Deng had to overcome the political barriers left from the previous period. Therefore, Deng promoted a pragmatist ways of thinking within the Party leadership, which has fundamental changed the political beliefs, attitudes, values and feelings of Chinese society at larger ever since. Dengs theory emphasized on practice rather than theory means. Moreover, Deng also promoted that white or black, it is a good cat as long as it catches nice, in his view, as long as China can achieve economic development and modernization, no matter what kinds of the measures are, the measures should be taken. From the above analysis, we can say that China not only has her own traditional culture, but also has her complicated political culture. All of the factors have big impact on Chinese negotiation style. The differences between Chinese negotiation and Americans negotiation Politics influence ¼Ã… ¡Lots of scholars pointed that, China always has a huge negotiation team but with little power on decision-making. (Adair, et al, 2001; Ghauri and Fang). To be specific, this power refers to the negotiation team power. The key reason to this phenomenon is in China, it is hardly to separate business from politics. In the Chinese Communist culture, they think politics is all-pervasive while on the contrast, Americans believe that business and politics should be separated (Pye, 1992). Ghauri and Fang also pointed that, if you want to do business in China, you should pay enough attention to the Chinese government because the government is the biggest boss and Chinese enterprises are just their factories. Chinese economic structure is more centralized while Americans is more open and free. They also indicated foreign firms should be sensitive to the guiding principles of Chinas social and economic development set forth by the Chinese Communist Party and the Chines e government, and also, should make a careful study of the Chinese governments priorities and implementation policies. In the contrast, Americans regard business is business and politics is politics, which are totally different aspects in the negotiation process. Legal Influence: The Chinese consider the interpersonal relationship is more important than legal contract, which is totally different from Americans. As Pye (1992) mentioned, Chinese culture traditionally shuns legal considerations and instead stresses ethical and moralist principles, whereas Americans are thought to be highly legalistic. So historically, Chinese and western cultures has quite different views about the importance of legal process. The Chinese seem to be bound by their tradition non-legalistic practices. Tian (2007) also indicated that, the Chinese negotiators do not pay much attention to legal agreement as western people do. They focus more on interpersonal trust, friendship and guanxi. Some American businessmen argued that they learned that among Chinese it was a traditional way to seal agreements with only the oral commitment, a nod of the head, or a handshake (Pye, 1992). This Chinese negotiation style is closely related to the Confucianism that required people t o appreciate interpersonal relationships rather than laws and legal regulations; and also, it is a reflection of emphasizes on the harmony. In the contrast, Americans consider legal contract is much more persuasive than personal relationship. As Pye (1992) indicated that the majority of American negotiators are lawyers, which means that the Americans consider the contract is the most important part of negotiation. Holistic Thinking: Graham and Lam pointed that; the Chinese always consider the question from a whole picture; however, the Americans think sequentially and individualistically. Chinese negotiators always start negotiations on the general principles first and leave details to the later stages (Tian, 2007). Also, Pye (1992) pointed the Chinese seek agreement on generalities, dwelling on overall considerations, and avoiding specific details as much as possible, leaving, as they like to say concrete arrangements to later negotiations. But the Americans are more in favour of solve problems one by one. Why the Chinese like use this negotiation style? The reason can be considered consistent with Maos bureaucratic heritage; the party leaders always set the general principles and the followers had to agree upon before any details can be discussed. According to Pye (1992) and Tian (2007), some western businessmen argued this as a negotiating ploy. They argued that Chinese negotiators can take advantages of the signed general principles at the later stage of negotiations. This ploy is quite obvious when it comes to the specific details. Assume that both parties were arguing about details while at this moment, Chinese negotiators can attack the other side for not complying with the general principles signed earlier. Therefore this can be called one of the thirty-six stratagems-shut the door to catch the thief. Nevertheless, even the western businessmen consider this as a ploy it still has its advantages. Pye (1992) said that Chinese can quickly turn an agreement on principles into an agreement on goals and then insist that all discussion on concrete arrangement must foster those agree-upon goals. This measure is useful during negotiation process approved by a American: by making each agreement between us move from a more general to a more technical level, the Chinese can constantly argue that what they were insisting upon in operating procedures was logically consistent w ith all that had been agreed to before.they sure taxed out patience and always put us on the defensiveà ¢Ã¢â€š ¬Ã‚ ¦ Information exchange (emotional aspect): the Americans pay more attention on the information exchange during negotiation process; they can accept the discussion as main method to solve the problems, even the discussion is very intensive. In contrast, the Chinese are focusing whether the counter party gives their face or not. In Chinese business culture, ones reputation and social standing rest on saving face. Assume that foreign businessmen cause the Chinese embarrassment or lose face, even unintentionally; it can be disastrous for negotiation process. Moreover, Tian (2007), Ghauri and Fang, found that face is extremely important for Chinese. They argued that if someone gives enough face to the Chinese negotiators, they will behave as a Confucian gentlemen otherwise they will return you back or set block in the negotiation process. Therefore, from this perspective we can see that compared with the Americans, the Chinese are thinking highly of face. Time issue: Americans in favour of fast meeting when negotiation, while the Chinese need much more time to build the trust with counter party before negotiation. The reason is influenced by Confucianism; Chinese only do business with someone they can trust; while trust building is a time-consuming issue. As one Chinese negotiator said they [western firms] want to come and sign the contract quickly and do not know that [if] we do not understand each otherà ¢Ã¢â€š ¬Ã‚ ¦there is no business relationship first, we have to know and trust each other, and then we sign the contract!(Ghauri and Fang). Patience: Compared with the Chinese, Americans are more impatient. As long as an initial agreement has been reached, the American negotiators become more than ever impatient for the consummation of a deal, for they tend to assume that the step from general agreement to detailed substantive negotiations should be a short one (Adair et al, 2001). In many cases, the impatience of the Americans is fuelled by the fact that it is not convenient, or economical, to keep their entire negotiating team in China doing nothing (Pye, 1992). For the Chinese, however, this may be the time for substantial delay. The officials who have been talking with the Americans may not have the authority to go further and must wait for the further instructions. The Chinese are also short of expert talent and thus lower officials may have to await the clearing of bottlenecks in their own hierarchies. Also, Chinese cadres often seem genuinely to feel that once there has been an agreement in principle, congratulati ons are in order, and therefore, they are in no hurry to get into the potentially troublesome haggling over details. Negotiation team: the Chinese negotiation team tends to be a large one but indecisive compared with Americans. According to Tian (2007), a western businessman pointed that it is common that lots of people from carious government departments and commissions (such like planning, economic and foreign trade commissions and the like) get involved in the negotiation team. Apart from government officials, some representatives from various departments of the Chinese company are often also invited to participate in the negotiating team, aims for avoid possible non-collaboration in the long term. The feature of the Chinese negotiation style is related to Maos bureaucratic heritage. In Americans view, once the agreement being signed, the negotiation process is over while the Chinese always tend to continue the process with continuously new questions (Pye, 1992). Chinese stratagems: The Chinese more likely to use stratagems during the negotiation process, while the Americans always being honest and humorous. Lots of scholars pointed that the Chinese in favour of using stratagems (Ji) during negotiation, which is too hard for them to identify (Tian, 2007; Fang, 2006; Miles, 2003). For example, when Ericson entered China during pre-negotiation stage, the Chinese changed negotiators suddenly, was being regarded as steal the beams and change the pillars, as mentioned above, the Chinese only doing business with the people they can trust with, without solid trust it is hardly for them to be truly honest, therefore they will use stratagems. As one negotiator admitted that they used the stratagems unconsciously but the stratagems occupied more than 10% in the negotiation process. This trait is widely recognized and highly respected by other delegations. Compared with the Americans, the Chinese negotiators are more conservative during negotiation, without any back guarantee or the higher direction from the upper level, the Chinese negotiators tend to be very careful, speak and act cautiously (Adler et al, 1992). Price-sensitive: the Chinese are sensitive to price. Lots of foreigner negotiators said that the Chinese often keep asking for lower price during the whole negotiation process. This difference compared with Americans discussed in almost all the influential studies on Chinese negotiation styles. Such like Tian (2007), Pye (1992). This sensitivity closely related to the Chinese agrarian mentalities, which emphasized thrift. It also related to Dengs pragmatism, based on the backward reality of China, which is, the resource is very limited that the Chinese have to pay attention to the cost issue. The similarities between Chinese negotiation and Americans negotiation Protectionism: some scholars argue that the Chinese always being protective to the local industries, especially for the national key industries, such like IT, telecommunication industry. Secondly, the huge but indecisive negotiation team should be improved. Due to the unique culture of China burea ucracy, the Chinese negotiation team always bigger than its actual needed. This is a waste of human resource; also, each department of the government should be separate from each other, each performs its own functions, if so, the efficiency of negotiation will be enhanced better. But to achieve this target, it will take a long time and the joint efforts of all departments. Thirdly, the Chinese always behave nothing is ever final even the contract signed already. This is a performance of bad faith; it is harmful for the Chinese to continue doing business with the foreigner partners. In other words, the root cause of this phenomenon is the indifference of Chinese legal concept. For the Americans, they should learn from the Chinese being patient when negotiating, it is easy to make loss due to the decision made when lost impatience.

In Johns’s work, the penniless and indigenous serve as the scapegoats for the priviledged and their obsession with grooming Mexico City to be a little Europe.   Ã‚  Ã‚  Ã‚  Ã‚  A growing affluent class called upon the Diaz regime and imported architects to construct buildings in the Zocalo to reflect a â€Å"proper† image that drew on influences from Europe and the United States. Johns recognizes the architectural dependence of the influential Mexicans constructing Mexico City when he states, â€Å"Mexican architecture, on the other hand, was an expression of a city run by a people who were looking to create their own culture while entirely dependent on the industry and ideas of Europe and America† (22). The same construction that the elite felt was a celebration of a newfound dignity in the Mexican people was criticized, by visitors and locals alike, as grandiose and a futile effort to shield the native roots of a circle of imposters. Johns’s argues that the â€Å"Mexicans knew little of their adopted European tradition, had acquired even less of its taste, and enjoyed none of its tranquility† (23). While the influence on the Westside led to development, the squalor and lack of authority of the peasants on the Eastside created mesones, or as Johns described them, â€Å"†¦a little more than ‘a bare spot to lie down in, a grass mat, company with (the) vermin that squalor breeds†¦Ã¢â‚¬â„¢Ã¢â‚¬  (48). Politics on the Westside of the Zocalo were concerned little with the living conditions of the majority. Europe and the United States served as a model for these citizens who craved status and acceptance due to the inherent inferiority complex gained by a historically conquered people.

This was the shining moment of America. Freedom was theirs, and this is what they have been wanting since the pilgrims arrived almost two centuries before. They were now going to take on an even greater task then fighting the British: establishing a system of government that would be fair and that would be accepted throughout all of America. One thing the founding fathers knew they had to do was establish a document that would unite the states under one system of laws, so they would be a single country. The Articles of Confederation were too weak and could not meet the demands the country as whole needed, so they drafted a new constitution. This new constitution was a brilliant document that expressed how there is no true sovereign power because the power ultimately lies in the people. This document, created in the Constitutional Convention in Philadelphia, was to become the foundation for our country and is still the chief document that the America of today follows. Nevertheless, there were still some people opposed to this document. The Anti-federalists, as they were called, believed that if the constitution was enacted then the central government would become too powerful. They believed America would then become a tyrannical government, which is what America fought so hard to get away from. The anti-federalists said a bill of rights was needed to stop the national government from being tyrannical. The states were able to unify as one to overcome a challenge. This event showed that the constitution could indeed work, and that the national government must posses some power in order for the country to stay as a whole. This was just one obstacle that America would be faced with in its short history, but it showed that a government whose intent is truly for the people and by the people can survive and withstand any obstacles.

Law enforcement is an exciting career that can open many doors to different jobs, from patrolling the streets to protecting important political figures. Police officers are an essential part of the communities in our nation, offering citizens protection from criminals, preventing crimes, and serving the members of their community. A police officer’s duties, among other things, include patrolling a specific district or beat, writing citations when necessary, offering escorts for convoys, responding to citizens’ emergency calls, severing warrants and subpoenas, and writing incident reports after a crime has been committed. 1 An essential characteristic of a police officer is physical stamina, physical and mental endurance, and the ability to keep a calm head. These are just a few of the many duties and essential characteristics of a police officer. A police officer’s work environment can vary greatly, either being out on patrol or in an office, either writing reports or viewing bulletins. Out on patrol, an officer’s work environment is his or her patrol car. A patrol car has all the devices necessary for an officer to execute his or her duties. It will contain a radio, a mobile laptop, which is used to run license plates, do background checks, and receive directions to the locations of 911 calls, and weapons, such as a shotgun, to be used in hostile situations. A police officer’s work environment will vary depending on his or her pecific duties. Becoming a police officer is a physically demanding process. Many people choose to first obtain a college degree in criminal justice or sociology, because it can help you become a higher rank and opens the options to work for higher authority agencies. The basic requirement for becoming a cop are to be free of any felony convictions, be a citizen of the United States, be at least 18 years of age, undergo background checks, and be free from any physical, emotional, or mental condition which might adversely affect the exercise of power by the peace officer. These requirements may vary slightly from state to state, but one that is consistent is that everyone must attend police academy. Police academy is an essential step in becoming a police officer. By graduating from police academy, a person becomes ‘post certified,’ which is a requirement to become a police officer anywhere. 3 At the academy, a person will take courses on firearms training, patrol techniques, crimes scene procedures, and ‘brain training’ courses, which train an officer on how to react mentally in certain situations. Physical fitness tests are an essential part of the academy, with strict requirements for both male and female requirements. Being a police officer requires both mental and physical toughness. A career in law enforcement can bring a variety of pay amounts. A standard patrol officer makes on average $34,000 a year. 4 Working for different agencies can bring different pay ranges, anywhere from $25,000 a year to $100,000. A police chief will earn towards the upper end of this range. All police officers will be members of a police union, the largest being the International Union of Police Associations, or the IUPA. 5 Being a member of a union brings benefits such as higher wages, health insurance, and a pension plan. Being a police officer is not one of the highest paying jobs staring off, but with the right promotions, one can earn a very high salary. Being a police officers is a career that is always in demand. In 2010, there were over 750,000 jobs for police officers.

Accountant Responsibilities By: Jennifer Koppelman March 11, 2014 Accountant Responsibility Accountants have responsibilities to many different groups such as their clients, the government and third parties. It is important that accountants act in a particular manner and have high ethical standards, integrity and professionalism. Accountant’s job responsibility is to validate financial statements and perform the duties in accordance with all the principles, standards and laws. Even though an accountant is hired by a company, they have a responsibility to many more people than just the company. Some of the people that accountants are responsible to, would be the company’s management, investors, creditors, outside regulatory bodies, and the integrity of the financial markets. Accountants need to be consistent and constantly be carefully exercising due diligence and pay close consideration of the materiality of content (Accountant Responsibility). Accountants have a code of professional conduct that they should adhere to. This states that accountants should maintain objectivity and be free of conflicts of interest in the discharging professional responsibilities. An accountant in public practice should be independent in fact and appearance when providing audit and other attestation services. Situations where accountants will need to show objectivity would be when they are felt compelled to deliver bad news to a client or employer based on an analysis that they had performed (Colson, 2004). There are two different types of auditors; internal auditors and external auditors which have different responsibilities. Internal auditors have the main responsibility to develop statements that present the financial situation of a company in a fair way, meaning that as much disclosure as necessary to give a reasonable picture of the financial situation to any user having a claim to the knowledge. External auditor’s responsibility is to affirm that this has happened by issuing an opinion as to whether the financial statement fairly presents the financial position of that corporation (Duska, 2005). Accountant Responsibility to Clients Accountants have a professional responsibility to clients to keep their information confidential. The rule states that a member in the public practice shall not disclose any confidential client information without the specific consent of the client. This also extends to other accountants not directly involved with the client who obtain information through practice reviews or sanctioned disciplinary hearings to maintain confidentially. There are certain exceptions that facilitate compliance with other professional and legal obligations. Maintaining confidentiality is not only a professional obligation but also a legal obligation. General knowledge and expertise obtained through a client engagement is not considered to be confidential information (Cashell). Accountants have ethical responsibility to protect their clients, produce financial statements and tax returns that are to the best of their ability after performing proper due diligence. If there was an event that an audit would occur for a government agency they should represent their clients with professionalism. Accountants should always maintain the highest ethical standards. Accountants perform essential and critical roles in society. Accountants have responsibilities to all of those who use their professional services. The American Institution of CPA’s has an official rule, Rule 301 states a member in the public practice shall not disclose any confidential information without the specific consent of the client. Accountant’s number one responsibility is to its clients, it is important that accountants do not disclose client information to anyone without the client’s permission first. There are consequences to the accountant if they do not keep client information confidential. It can also have a negative effect on the clients business, which will negatively affect the accountant also (ET Section 301 – Client Confidential Information). CPA Responsibility to Clients Case Even when an accountant has the intention to warn others of pending financial harm the courts have held that accountants must not give any client information, client information should always remain confidential. In a case Wagenheim v. Alexander Grant & Co the court ruled that Alexander Grant improperly divulged confidential information about their client, Consolidata Data Services, to other clients. Consolidata Data Services, an audit client of Alexander Grant performed payroll services for several of Alexander Grant’s other clients. Alexander Grant discovered that Consolidata Data Services was having financial difficulty; Alexander Grant warned their other clients to stop doing business with Consolidata Data Services. Alexander Grant argued that the other clients would suffer financial damage without warning them. The ruling was against Alexander Grant, the court said that there was no proof that Consolidata Data Services was in a financial hardship that they could not recover from. Which Alexander Grant had no legal right to inform third parties of the financial burden that Consolidata Data Services was in (Cashell, 1995). It is important that accountants keep client information confidential at all times. The accountant might not know the whole picture of a business and a company can state that they could have recovered from the financial burden but because the accountant may have told other clients that could ruin the reputation of the client and affect the business. It is always safer not to say anything in regards to the financial situations when you have an obligation to your client. Accountant Responsibility to Third Parties Accountants do not have as much liability to third parties as they do to clients. Accountants have a liability to third parties who are relying on the audit information, only if there is fraudulent conduct or proof of negligence would they be liable to the third party. When public accountants are done with an audit of their clients records and financials they put an opinion letter which sets forth, among other things, the scope of the audit and a professional opinion concerning the financial representations. Even though third parties may rely and act upon the auditor’s opinion, the auditor is contractually bond only to the client and usually owes nothing, no legal duty to third parties for negligence (Greene, 2003). Accountants need to be very careful when warning outsiders of a client’s fraud. Based on prior court cases, CPA’s generally do not have an obligation to inform outsiders of known fraud unless if they remain silent they are becoming culpable themselves. It is a risky situation if an accountant decides to â€Å"blow the whistle† (Cashell, 1995). Accountants are generally not responsible to third parties in contracts because there is no privity of contract. However, accountants can be held to be a common law duty of care towards third parties in certain circumstances, despite that there is no contractual duties. Circumstances that give rise to such duty have been considered in a substantial number of cases in recent years and three general tests have been developed. One of the tests would be if there is foreseeability damage, proximity between parties and considerations of justice and reasonableness. Another test would be testing the assumptions of reasonability. If the court would take an incremental approach in comparing the relationship in any given case to previously decided cases in which a duty of care had been recognized or rejected. An accountant can be liable to a third party if the accountant knew or should have known that they were relying on the audit, only for fraudulent conduct and proof of mere negligence is not sufficient. If the accountant knew that the audit report for the client was intended to supply the information to a third party who would rely on the information. If the third party would be relying on the information in a decision concerning transactions involving the client and the third party (Professional Liability of Accountants & Auditors). Duty to Disclose to Third Parties In some cases information should be disclosed to third parties but an accountant needs to be very careful and proceed accordingly. If it is detailed in their engagement letter, which is a written agreement to perform services in exchange for compensation then an accountant has a duty to disclose information. Once the letter is signed off on by an officer then the letter serves as a contract (Engagement Letter). In one case; Fund of Funds Ltd. v. Arthur Andersen & Co. the CPA had a duty to disclose. Arthur Andersen was the auditor for two clients, Fund of Funds and King Resources Corp. King Resources Corp developed natural resource properties and agreed to be the sole vendor of such properties to Fund of Funds at prices no higher than those charged to King Resource Corp industrial clients. Arthur Andersen learned the agreement was not being met but failed to inform Fund of Funds. The court did rule that Arthur Andersen should have disclosed this fact to Fund of Funds because they had knowledge of the overcharges, knew the terms of the agreement that was being violated and the language of their engagement letter produced a contractual obligation to reveal that information. Another case involving duty to disclose, this one a CPA was found that he did not have a duty to disclose information. The case Gold v DCL Inc. , Price Waterhouse & Co. informed DCL in December that they intended to qualify their audit report on DCL’s financial statements. DCL was in the business of leasing computers and Price Waterhouse believed that their ability to recover their computer equipment costs was impaired due to the impending release of a new line of more powerful computers by IBM. In February, DCL announced earnings without mentioning Price Waterhouse’s concern and on February 15 Price Waterhouse was replaced. The court ruled that there was no basis in principle or authority for extending an auditors duty to disclose beyond cases where the auditor is giving or has given some representation or certification and the silence and inaction of the defendants auditors did not make them culpable. The court’s reasoning that the CPA did not have to disclose was because the auditors had issued no public opinion, rendered no certification and in no way invited the public to rely on their financial judgment there was no special relationship that imposed a duty of disclosure (Cashell, 1995). Accountant Responsibility to the Government Different local, state and federal governments have different rules and regulations that accountants need to learn for the area and industry that they will be working in. This is important to find out and comply with the different regulations. This is part of an accountant’s responsibility to provide accounting services that are in compliance with the government regulations for your client’s particular industry. There may be different regulations for different industries so it is important to know which regulations are pertinent to your client. CPA for Responsibility to Government Case Some state laws might grant accountant client privileges, but these laws do not usually extend to a summons or subpoena related to a Federal Investigation by such agencies such as the IRS, or the SEC. In a case, Couch v. United States, the Supreme Court concluded that no Federal accountant client privilege exists and state created privileges do not apply to Federal cases. Before an accountant is responding to a Federal agency, the accountant should be sure that they are only responding to a valid and enforceable subpoena. In another case, Roberts v. Chaple, the Appellate Court ruled that the accountant violated Georgia’s statutory accountant client privilege because he provided information to the IRS without having been served a valid summons or subpoena. Some state privilege laws could also affect the ability to release information pursuant to a review of a CPA’s practice. Firms are responsible for meeting and keeping client confidentiality obligations whenever state statutes do not clearly provide a confidentiality exemption for a peer review of a firm’s practice. Whenever an accountant is not sure on if information should be released it would be best to consult a lawyer and obtain legal counsel to ensure that they are not breaking any laws or violating any confidentiality agreements or obligations(Cashell, 1995). Conclusion Accountants need to be ethical and practice with the highest professionalism and ethics. Accountants have many responsibilities not only to the client that they are servicing but to the government and to third parties. Responsibilities are higher to clients then third parties but it is important to know when and where your responsibility for each is. If an accountant is negligent or not responsible to the parties when they should have been there are consequences. An accountant’s main responsibility is to their client, it is important to keep client information confidential at all times. Not keeping client information confidential can have a negative effect and consequences on the accountant and the client. It is important that accountants do not disclose client information without the permission from the client first. All accountants need to have and maintain the highest ethics, professionalism and confidentiality.

Coronary Heart Disease

Coronary heart disease or CHD is a narrowing of the small blood vassals that supply the heart with blood and oxygen. The disease develops when a combination of fatty material, calcium, and scar tissue or plaque, builds up in the arteries that supply the heart with blood. This slows the blood flow and causes chest pain. Men in their 40s have a higher risk of CHD than women. But, as women get older, their risk increases so that it is almost equal to a man's risk. Factors that put you at a higher risk of developing CHD are, diabetes, high blood pressure, â€Å"bad† cholesterol, not getting enough physical activity or exercise, obesity, and smoking. Children with parents who have heart disease are more likely to develop it themselves. African Americans have more severe high blood pressure than Caucasians and a higher risk of developing CHD. Risk is also higher among Mexican Americans, American Indians, native Hawaiians and some Asian Americans. This is partly due to higher rates of obesity and diabetes. Men have a greater risk of heart attack than women do, and they have attacks earlier in life. Even after menopause, when women's death rate from CHD increases, it's not as great as men's. Over 83 percent of people who die of coronary heart disease are 65 or older. At older ages, women who have heart attacks are more likely than men are to die from them within a few weeks. Treatment depends on your symptoms and how severe the disease is. There are three main types of treatment for Coronary Heart Disease: lifestyle, medication, and, for advanced atherosclerosis, special procedures. The first two types of treatment also can help prevent the development of Coronary Heart Disease. The Lifestyle treatment has 6 main steps to help you prevent or control CHD.
